摘要 原产地是指货物生产或制造的国家或地区，而原产地规则就是确定货物原产 地时所依据的标准和规范。根据 WTO 规范的要求，进一步完善我国的原产地规 则是推进中国经济全球化进程的一个必然趋势，是充分地参与国际贸易体系，制 定和调整我国有关国际贸易政策，解决国际贸易争端的前提条件。而原产地管理 是国家赋予海关的重要职能之一, 原产地管理职能发挥的好坏直接关系到海关 能否全面履行国家赋予的使命, 海关应当增强原产地工作的敏感性, 最大限度 维护国家利益。本论文就是从海关作为原产地管理部门的角度出发，通过对现有 的货物原产地规则的深入分析，通过分析目前我国货物原产地规则存在的不足以 及对我国贸易和经济利益产生的不利影响，从而提出完善的建议： 一是建立系统完善的原产地立法体系，通过统一原产地立法和管理部门、完 善原产地标准以及简化原产地规则的管理和实施等三个方面措施，制定出与国家 经济产业发展相适宜的货物原产地规则。并且通过统一原产地管理部门，强化海 关作为货物原产地管理主管机构的职能和地位，让海关在原产地管理的舞台上发 挥更大的作用。 二是从海关作为货物原产地主管部门的角度出发，从风险管理方面、加强与 商界合作方面以及加强队伍建设等方面对海关加强原产地管理，提高执法水平提 出建议。 关键词：原产地，海关管理 Abstract The country of origin refers to the country or region which produce or manufacture the goods. And the rules of origin means the standards and specifications which can determine the country or region that the goods come from. According to the requirements of the WTO rules, it is an inevitable trend of economic globalization that to improve our countrys rules of origin. Now China is fully involved in the world trade system, it is a precondition to solve the international trade disputes that formulating and adjusting the relevant international trade policies of our country. And the management of origin is one of the important function which was authorized to customs. If the customs takes a good role at the management function of origin, it can fully fulfill the mission given by the state. For this reason, the customs shall improve the sensitivity in the management of origin, for the purpose of safeguard the national interests. This paper is from the perspective of the customs which is as the management department of country of origin, deeply analyses the existing rules of origin of goods, find out the insufficiency and adverse impact on Chinas trade and economic interests at present, and then offer the proposals: On the one hand, it is to build a perfect legislation system of origin.
