营养保健食品与特殊膳食进口报关知识热点

一、进口健康食品清关所需资料：

1、生产国原产地证与卫生证书；

2、国外自由销售证明；

3、产品全成分分析表；

4、供应商灌装日期证明；

5、合同、INVOICE、装箱单；

6、食品原标签(包括前标、英文背标及翻译件的电子档）；

7、进口食品收货人备案编号；

8、进口食品发货人备案编号；

9、海关提单或空运运单；

10、报关报检委托书；

11、保健食品进口批文【如保健品需要提供】。

Information required for customs clearance of imported health food:

1. The certificate of origin and health certificate of the country of manufacture;

2. Proof of free sales abroad;

3. Product full composition analysis table;

4. Proof of the filling date of the supplier;

5. Contract, INVOICE, packing list;

6. The original food label (including the electronic file of the front label, English back label and translation);

10. The power of attorney for customs declaration and inspection;

11. Approval for the import of health food [if health food needs to be provided].

二、健康食品进口报关：

1、进口的食品如产品标签与包装上声称有保健功能的，或以补充维生素、矿物质为目的的，以及原料中含有相关部门公布的《可用于保健食品的物品名单》中所列成分的产品，海关一律按照保健食品进口进行管理。

2、以保健食品名义进口的特殊剂型食品，报检时应提供《进口保健食品批准证书》，进口产品的品名、生产企业、功效成分及保健功能等信息必须与《进口保健食品批准证书》一致。

3、进口散装特殊剂型食品，报检时应提供国内分装企业生产加工此产品的资质证明，无法提供的海关不予受理报检。

4、如采用跨境电商模式进口清单上的保健类食品，可无需提供进口保健食品批准许可证。

5、进口的营养食品是否属于保健食品，是否需要特殊的许可方可进口，取决于产品的成分含量以及标签宣传等各方因素。

6、进口保健食品与特殊膳食食品的境外生产企业，必须申请进口食品境外生产企业注册手续，且应当其由所在国家（地区）主管当局向海关推荐注册。

Health food import declaration:

1. Imported foods that claim to have health-care functions on the product label and packaging, or for the purpose of supplementing vitamins and minerals, and the raw materials contain the ingredients listed in the "List of Goods that Can Be Used in Health Foods" published by the health administration department Customs will manage all products in accordance with health food imports.

2. For special formulation foods imported in the name of health food, the "Imported Health Food Approval Certificate" should be provided when applying for inspection. The name of the imported product, manufacturer, functional ingredients and health functions must be consistent with the "Imported Health Food Approval Certificate" .

3. For imported bulk foods with special formulations, the qualification certificate of the domestic sub-packaging enterprise for the production and processing of this product should be provided when applying for inspection.

4. If you use the cross-border e-commerce model to import health foods on the list, you do not need to provide an import health food approval license.

5. Whether the imported nutritious food is a health food and whether it requires a special license to be imported depends on various factors such as the content of the product and the label promotion.

6. Overseas production enterprises that import health food and special dietary foods must go through the registration procedures of imported food overseas production enterprises, and the competent authority of the country (region) where they are located should be recommended to the General Administration of Customs for registration.

三、进口健康食品中文标签：

1、进口食品必须加贴中文标签，中文标签必须符合中国的法律法规规定；

2、进口预包装食品的标签可同时使用外文，但所用外文字号不得大于相应的汉字字号。对于法律、法规、食品安全标准要求的强制标识内容，中文、外文应有对应的关系。

3、进口食品的销售单元包含若干可独立销售的预包装食品时，直接向消费者交付的外包装（或大包装）标签标示要求：

【1】该销售单元内的独立包装食品应分别标示强制标示内容。

【2】外包装（或大包装）的标签同时按照要求标示，若外包装(或大包装)易于开启识别、或透过外包装(或大包装)能清晰识别内包装物(或容器)的所有或部分强制标示内容，可不在外包装(或大包装)上重复标示相应的内容。

4、自2022年1月1日起，进口保健食品、特殊膳食用食品的中文标签必须印制在最小销售包装上，不允许加贴中文标签。

Chinese label of imported health food:

1. Imported food must be affixed with Chinese labels, and Chinese labels must comply with Chinese laws and regulations;

2. The labels of imported pre-packaged foods can use foreign languages at the same time, but the foreign font size used shall not be larger than the corresponding Chinese font size. For mandatory labeling content required by laws, regulations, and food safety standards, there should be a corresponding relationship between Chinese and foreign languages.

3. When the sales unit of imported food contains several pre-packaged foods that can be sold independently, the labeling buyer for outer packaging (or large packaging) delivered directly to buyer:

[1] The individually packaged foods in the sales unit shall be separately labeled with mandatory labeling content.

[2] The label of the outer package (or large package) shall be marked as required at the same time, if the outer package (or large package) is easy to open and identify, or the inner package (or container) can be clearly identified through the outer package (or large package) All or part of the mandatory labeling content may not be repeated labeling the corresponding content on the outer packaging (or large packaging).

4. Starting from January 1, 2022, the Chinese labels of imported health foods and special dietary foods must be printed on the smallest sales package, and Chinese labels are not allowed.
